DUNST REGULATIONS

1. Definitions

• Postal address – name and surname or name of the institution, location in the town (in the case of a town divided into streets: street number, apartment or flat number, in the case of a town not divided into: streets and city number), postal code and town .

• Price list of delivery options – delivery in Poland is free and takes place via DPD or UPS courier. Delivery in other countries except Poland takes place via a courier company GLS or UPS. The total costs are available in the order form or at www.dunststore.com/dostawa

• Proof of purchase – an invoice, bill or receipt issued in accordance with the Goods and Services Tax Act of March 11, 2004, as amended and other applicable laws.

• Client – a person of legal age with full legal capacity, a legal person or an organizational unit without legal personality and having the capacity to perform legal acts, making at the Seller a purchase directly related to its business or professional activity.

• Civil Code – Civil Code Act of April 23, 1964, as amended. 

• Code of good practice – a set of rules of conduct, in particular ethical and professional standards, referred to in Article 2, point 5 of the Act on Counteracting Unfair Market Practices of August 23, 2007, as amended.

• Consumer – a person of legal age with full legal capacity, making a purchase from the Seller not related directly to its business or professional activity. 

• Basket – a list of products made from the products offered in the store based on the Buyer’s choices.

• Buyer – both Consumer and Customer.

• The moment of giving away an item – the  moment at which the Buyer or a third party indicated by him to take possession will take possession of it. 

• Payment – method of payment for the subject of the contract and delivery.

• Consumer law – the Consumer Rights Act of 30 May 2014.

• Product – the minimum and indivisible number of items that can be the subject of the order, which is given in the Seller’s shop, as a unit of measure in determining its price (price / unit).

• Subject of the contract – products and delivery being the subject of the contract 

• Object of the service – subject of the contract.

• Thing – a movable thing that may or may be the subject of a contract.

• Shop – internet service available at www.dunststore.com via which the Buyer can place an order.

• System – a team of cooperating IT devices and software, ensuring processing and storage, as well as sending and receiving data through telecommunications networks using the end device appropriate for a given type of network, commonly referred to as the Internet.

• Delivery deadline – up to 14 business days from the date of receipt of the money to your account.

• Contract – an agreement concluded outside the business premises or at a distance within the meaning of the Act on Consumer Rights of 30 May 2014 in the case of Consumers and a sales agreement within the meaning of art. 535 of the Civil Code of 23 April 1964 in the case of Buyers.

• Physical defect – the incompatibility of the item sold with the contract, in particular if the item: does not have properties that this kind of thing should have due to the purpose in the contract marked or resulting from the circumstances or destination; has been delivered to the Consumer in an incomplete state. 

• Order – Buyer’s declaration of intent made through the store, clearly specifying: the type and quantity of products; type of delivery; payment method; Buyer’s data and aiming directly at the conclusion of the contract between the Buyer and the Seller.

2. General conditions

• The contract is concluded in accordance with Polish law and these regulations.

• The seller is obliged and undertakes to provide services and deliver items free from defects.

• All prices quoted by the Seller are expressed in Euro and are gross prices (including VAT). In the case of shipments abroad, the cost of delivery is added in the final stage of the order.

• All deadlines are calculated in accordance with art. 111 of the Civil Code, i.e. the period marked in days ends on the last day, and if the beginning of the period marked in days is an event, it is not taken into account when calculating the date of the day in which the event occurred.

• Confirmation, disclosure, consolidation and protection of all material provisions of the contract in order to gain access to this information in the future takes place in the form of: confirmation of the order by sending to the e-mail address, adding to the completed order, sent to the indicated place of issue of the printed proof of purchase .

• The Seller provides the Buyer using the system with the correctness of the store operation in the following browsers: IE version 7 or newer, FireFox version 3 or newer, Opera version 9 or newer, Chrome version 10 or newer, Safari with the latest versions of JAVA and FLASH installed, on screens with horizontal resolution above 1024 px. The use of third party software affecting the functionality and functionality of browsers: Internet Explorer, FireFox, Opera, Chrome, Safari may affect the correct display of the store, so in order to get the full functionality of the store www.dunststore.com, you must disable them all. 

• The seller applies to the code of good practice.

3. Conclusion of the contract and implementation

• Orders can be placed 24 hours a da.

• In order to place an order, the Buyer should perform at least the following steps, some of which may be repeated many times:

– adding a product to the basket;

– choice of payment type;

– selection of the place of issue of the item;

• Conclusion of the contract with the Consumer takes place when the order is placed.

• Consumer order processing payable by bank transfer or via the electronic payment system after the Consumer’s payment is credited to the Seller’s account, which should take place within 7 days of placing the order unless the Consumer was unable to meet the fault and informed the Seller .

• Conclusion of the contract with the customer takes place at the time of acceptance of the order by the seler about which he informs the customer within 24 hours of placing the order.

• Sending the subject of the contract takes place within 14 business days. The period starts from the moment the order is processed.

• The purchased subject of the contract is sent together with the sales document to the place of delivery of the item indicated by the Buyer in the order.

• If the order can not be processed, the Store will notify the Customer about this fact at the latest within 21 days from the date of receipt of the order confirmation by the Customer.

• The notification will be sent to the e-mail address indicated by the Customer in the order form. If the Customer pays for the order referred to in the sentence above, the Store will refund the money paid.

• If it is not possible to execute part of the order, the customer is informed about the status of the order and decides on the manner of its implementation. The customer has the following options: – partial implementation – the customer decides to execute the order from the products available at the moment; – cancellation of the entire order;

• Photographs and other forms of visualization and product presentation presented on the Store’s websites may not reflect their real size – they are informative.

4. Returns and exchanges

• According to the Act from March 2, 2000 on the protection of consumer rights and liability for damage caused by a dangerous product (Journal of Laws No. 22, item 271, as amended), the buyer has the possibility to return / exchange purchased goods.

• The deadline to withdraw from a distance contract is 14 days from the date of delivery of the item.

• Withdrawal from the contract for its validity requires the customer to submit a completed return / exchange form, which will be made available to the Customer by the Seller after receiving such information via e-mail to the address www.dunststore.com. The completed return / exchange form should be sent along with the goods and proof of purchase to the following address:

• Goods returned / exchanged can not bear signs of use. Delivery must be intact, i.e. in which it was delivered to the customer.

• The seller immediately confirms to the consumer by e-mail (provided at the conclusion of the contract and another, if it was given in the submitted statement) receiving the return / exchange form 

• In the event of withdrawal from the contract, the contract is considered void.

• The consumer is obliged to return the item to the Seller immediately but not later than within 14 days from the date on which he rescinded the contract. To meet the deadline the Customer is to return the item before its expiry.

• The consumer sends back the items being the subject of the contract from which he resigned at his own expense and risk.

• The consumer is liable for a decrease in the value of the thing being the subject of the contract and resulting from using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of things.

• The Seller shall promptly, no later than within 14 days from the date of receipt of the return form submitted by the Consumer return to the Consumer all payments made by him, omitting the cost of delivering the item or replacing the product at the expense of the Consumer.

• In the case of returning the goods, the Seller shall refund the payment using the same method of payment as used by the Consumer, unless the Consumer has explicitly agreed to a different payment method.

• Consumer, pursuant to Article 38 of the Consumer Law, is not entitled to withdraw from the contract: in which the price or remuneration depends on fluctuations in the financial market over which the Seller has no control and which may occur before the deadline to withdraw from the contract; in which the subject of the service is a non-prefabricated item, manufactured according to the consumer’s specification or serving to satisfy his individual needs; in which the object of the service is an item delivered in a sealed package, which after opening the packaging can not be returned due to health protection or hygiene reasons, if the packaging was opened after delivery; in which the subject of the service are things that after delivery, due to their nature, are inseparably connected with other things.

5. Privacy policy and personal data security

• The administrator of databases of personal data provided by Consumers of the store is the Seller.

• The Seller undertakes to protect personal data in accordance with the Personal Data Protection Act of August 29, 1997 and the Electronic Services Provision Act of July 18, 2002. The Buyer giving his personal details to the Seller when placing the order agrees to their processing by the Seller in order to complete the order.

• Detailed rules for the collection, processing and storage of personal data used to process orders by the store are described in the Privacy policy tab.

6. Final provisions

• Nothing in these regulations is intended to infringe the Buyer’s rights. It can not be interpreted in this way because in the event of any incompatibility of any part of the regulations with applicable law the Seller declares absolute compliance and the application of this right in place of the challenged provision of the regulations.

• The current version of the regulations is always available to the Buyer in the Terms of Service tab.

• In matters not covered by the regulations, the provisions of Polish law, in particular the Civil Code and the provisions of the Act on special terms of consumer sales and amendments to the Civil Code (Journal of Laws No. 141 of 2002, item 1176) and the Act on the protection of certain consumer rights shall apply and about liability for damage caused by a dangerous product (Journal of Laws No. 22 of 2000 item 271).
